1. Acceptance of Terms

These Terms of Service ("Terms") govern your download, installation, and use of the Tocky mobile application on iOS and Android (the "App") and its associated website. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use Tocky.

2. Description of Service

Tocky is a digital well-being utility designed to help users curb excessive social media usage. On Android, Tocky monitors active feeds and scroll cycles on selected target applications and overlays a custom lockout screen once user-configured scroll limits are reached. On iOS, Tocky uses native Screen Time controls to shield selected applications during focus sessions, allowing temporary unshielding intervals upon completion of focus tasks. To unlock or unshield the target applications, users must wait for the countdown timer to expire or complete chosen cognitive tasks (such as breathing exercises or mindful typing challenges) to confirm alert intentionality.

3. Device Permissions & Integration Requirements

To perform its core monitoring and locking functionalities, Tocky accesses native platform APIs. Tocky does not require manual sign-up or user account creation; instead, it automatically associates preferences with your device's unique platform token (Apple App Store ID / Vendor ID on iOS, or Google Play ID on Android). Depending on your platform, the App requests:

• iOS Platform: Integration with Apple's official Screen Time API frameworks (FamilyControls, DeviceActivity, and ManagedSettings). Authorizing these permissions is voluntary but required to authorize and enforce app shields and lockouts.
• Android Platform: Activation of Android's Accessibility Service and System Alert Window (Draw Over Other Apps) permissions. These permissions are used strictly to count scroll swipe events inside designated social feeds and overlay lockout panels.

We do not use these permissions or identifiers to access, read, transmit, or store any personal screen contents, private chats, messages, passwords, or web inputs.

4. Subscription Plans, Free Trial, and Billing Terms

Tocky requires an active paid subscription to function. Access to the App's functionalities requires an active subscription, which begins with a 3-day free trial:

• Free Trial Period: Your subscription begins with a 3-day free trial. If you do not cancel the subscription at least 24 hours prior to the end of the trial period, your subscription will automatically convert into a paid recurring plan and your Store Account will be billed.
• Auto-Renewal Policy: Subscriptions automatically renew at the same price and duration unless auto-renew is disabled in your App Store or Play Store Account Settings at least 24 hours before the current billing period ends.
• Cancellations & Refunds: You can manage and cancel your subscriptions directly within your Google Play Store or Apple App Store Account Settings. Refunds are managed exclusively by Apple or Google depending on your platform and billing checkout policies.

5. Intellectual Property

All trademarks, logos, brand assets, source codes, graphics, and user interfaces associated with Tocky are the exclusive property of Tocky. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Disclaimer of Warranties and Limitation of Liability

Tocky is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Under no circumstances shall Tocky be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use, inability to use, or bypass of the App's blocking systems. We do not guarantee that the App is completely bypass-proof or that it will operate without interruption due to native OS updates or device restrictions.

7. Age Eligibility and Child Safety

By using Tocky, you represent that you are at least 13 years of age. Tocky is not directed to children under 13. If you are under the age of 18 (or the age of majority in your jurisdiction), you must review these Terms with a parent or legal guardian to ensure understanding and consent to these binding Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction.
